The Expansion of Pretrial Detention Between Legal Legitimacy and Guarantees for the Protection of Defendants’ Rights

The International Humanitarian Law Center in Libya, in cooperation with the National Institution for Human Rights in Libya and “Nahnu” Foundation, participated in organizing a joint legal dialogue session entitled:

“The Expansion of Pretrial Detention Between Legal Legitimacy and Guarantees for the Protection of Defendants’ Rights”

The session was held on Sunday, 10 May 2026, at 4:00 PM in Tripoli, with the participation of a number of legal experts, human rights advocates, and individuals interested in justice and human rights issues.

The discussion addressed several issues related to pretrial detention, including the legal and human rights dimensions of its expanded use, the challenges associated with prolonged detention periods, and the extent to which such practices comply with the principles of fair trial and the legal guarantees afforded to defendants under national legislation and international human rights standards.

The session also featured extensive discussions on the importance of achieving a balance between the requirements of criminal justice and the necessity of protecting fundamental rights and freedoms. Participants further emphasized the need to develop legal policies and procedures that limit excessive reliance on pretrial detention and strengthen respect for the rule of law.

This session was organized as part of joint efforts aimed at promoting legal and human rights awareness, creating spaces for dialogue on issues related to justice sector reform, and reinforcing the principles of justice and human rights in Libya.
